For instance, girls are encouraged to be emotional, subjective, and fearful at an early age. A good example is a case outlined by Porter in his lecture, where he admits that he would let her daughter cry and assure her that she had his back (Porter, 2010). However, this was not the same for his son, who would be encouraged to go to his room, compose himself, and come back to explain what was wrong whenever he came home crying. However, according to Lorber (2012), things are now changing as men are taking care of little children, a function that has been traditionally shelved for women, boys and girls are now wearing unisex clothes, while both men and women are working in the same jobs, especially those that were traditionally gender restricted.

However, men are afraid of getting outside the man box. One of the primary reasons why men are so scared of leaving the man box is the cultural influence. According to Porter, the man box has been part of the culture for long, which has been traditionally passed through from one generation to another. A contract is a form of agreement that governs and recognizes the duties and rights of various parties involved in a settlement. A contract is legally binding, which means that all parties are obliged to fulfill their agreement, failure to which might lead to a lawsuit. According to the Anglo-American common law, the primary components of a contract include an offer, acceptance, considerations, and intentions to abide. The bill also requires that all the parties entering into a contract must have the capacity to do so. This includes having attained the age of majority, be of sound mind, and not be under the influence of drugs. Some contracts require formalities such as a deed or are written (Arvind, 2017). However, all contracts, including oral agreements, are legally binding. However, under civil law, a contract is regarded as an affiliate of the law of obligation.

Question 1

Under the Offensive Weapons Act of 2019, it is evident that Thor should not be prosecuted for ‘offering for sale’ a weapon under the Restriction. Initially, section 1 of the Restriction of Offensive Weapons Act 1959 had outlined several weapons that were restricted for sale in the country, which included the sale and supply of gravity and flicks knives. However, the 2009 amendment of the same law included other weapons such as the mythical hammers in the list of restricted weapons (Sexton, 2016). However, in the case of Thor, his hammer, which was retailing for £5,000 could not necessarily be a mythical hammer, but any other form which is not restricted for sale under the law.

However, it is evident that Thor’s conduct represents an invitation to treat or offer for sale. Notably, an invitation to treat is a concept of the contract law that involve the expression of the willing to negotiate. However, an individual making an invitation to treat has no intentions of being bound as soon as a third party accepts the offer. In this case, Thor put his hammer for sale in the Avengers Shop window with a price tag of ‘£5,000’ attached to it, which is a clear indication that he was inviting to treat anyone that would be interested in purchasing his hammer. Moreover, it is generally assumed that all advertisement are invitations to treat and not offers (Law Teacher, 2017). Therefore, individual advertising is not compelled to sell, the same case with Thor, whose ‘£5,000’ tag on his hammer does not necessarily mean that he had intentions to sell in law. Therefore, polices’ intentions to arrest Thor for ‘offering for sale’ a weapon under the Restriction of Offensive Weapons Act 2019 are illegal, considering that Thor’s display was a mere advert, which is regarded as an invitation to treat and not an offer.

Question 2

Notably, Tony Stark’s email constitutes an invitation to treat and not an offer. The primary difference between an offer and an invitation to treat is that the latter involves some preliminary discussion before an offer is made to the buyer, while an offer is when the seller is of one mind (Grundmann, 2015). Moreover, an offer becomes legally binding immediately it has been accepted by the third party, while an invitation to treat is not lawfully binding directly because it is not assumed the offered had intended to sell the product by pacing in the market.

Moreover, as indicated earlier, all adverts are considered an invitation to treat and not offers. In this case, Stark’s email can be considered as an advert, thus disqualifying it as an offer. Such is because he sent the same email to three parties, thus prospective for any possible buyers among them without having any specific customer in mind. According to the contract law, in an offer, the contractor is of one mind (Sexton, 2016). Thus, in the case of Stark, he could have sent the email to a single individual, especially if the deal was an offer. Another factor showing that Stark’s email was an invitation to treat is his willingness to negotiate with his targeted clients. Notably, Bruce Banner initially tried to negotiate with Stark, offering to purchase the adamantium for £950, instead of the initial retail price of £1,000. However, the refusal does not mean that Stark could not have accepted another Bruce’s offer. Such is because negotiations are typical in an invitation to treat, but not the case with an offer. The only thing that barred Stark from selling the rare metal to Bruce is that he did not get his reply email on time.

Question 3

Bruce Banner’s first reply to Stark does not communicate valid acceptance to the seller. According to the contract law, a valid approval must fulfill all the necessary conditions before qualifying as one. For instance, an acceptance must be made by the individual in which the initial offer was made (Eigen, 2012). The acceptance must be communicated directly to the offeror, and also be made in the prescribed mode. Besides, a valid acceptance should be unqualified and absolute.

In this case, although Bruce first reply fulfills a majority of the essential elements for a valid acceptance, it fails to satisfy one crucial aspect. Such is the assumption that a valid acceptance must be unqualified and absolute. Notably, this means that the acceptance should agree to all the terms of the offer and without a condition. Moreover, acceptance with a variation is regarded as a counteroffer and not an acceptance. In this case, Bruce first email included a counter offer, where he had bargained to pay £950 instead of £1,000, which was the first offer. Moreover, the reply did not agree to all the terms and conditions of the initial offer, which is a necessity regarding valid acceptance. Such is because Bruce disagreed with the initial price. Also, the fact that Tony Stark’s email was an invitation to treat and not an offer makes Bruce’s first email non-valid acceptance (Kruisinga, 2014). Such is because an advert does not mean that the seller is willing to bide to an agreement immediately an offer is accepted.

Question 4

Both Steve and Natalia’s communication methods are acceptable as far as the law of contract is concerned. According to the elements of a valid acceptance, acceptance must be made in the mode prescribed. This is primarily in the case that an offeror specifies a specific manner for which the offered should accept the contract.  For instance, an offeror may indicate that acceptance is made through postal services or email (Eigen, 2012). However, in the case where the offeror does not prescribe a preferred method of acceptance, any technique used by the offered is legally binding. In the case of Tony Stark, he had not specified on his preferred mode of reply, making both the email and postal methods employed by Steve and Natalia to communicate acceptably.

However, according to the contract law, Natalia is concerned as the first person to accept the offer. Such is despite replying much later than Steve, who had communicated the next day immediately he saw the email. Notably, a legally binding contract abide into rules of a valid agreement. One of the major requirements of an agreement is that it should include the consent of both parties. However, according to this situation, a valid acceptance is considered legally binding when they offered to communicate effectively to a seller (Chen-Wishart, 2018). However, Tony Stark did not receive Bruce mail until 26th April 2019, despite having been posted on second the same month. Thus, Stark cannot consider an acceptance before a proper communication is made, thus making Natalia the first person to accept.

On 1 April 2019 Tony Stark wrote an email to the Avengers Investment Group (AIG), which includes Steve Rogers and Natalia Romanova, stating the following: ‘I have a piece of the highly rare metal, adamantium, and was wondering if anyone in the AIG would like to purchase it from me for £1,000. Regards, Tony.’

Having read the email, Bruce Banner replies on the same day (1 April 2019) saying ‘I will buy the adamantium for £950.’ On the same day (1 April 2019) Tony refused to accept that price. Bruce then tried to accept the original offer of £1,000 and Tony did not respond.

Steve Rogers was attracted by the prospect of buying the adamantium to make a new shield. However, as someone who was born many years ago, Steve was not good with modern technology and decided to communicate his acceptance by post. He wrote a letter and posted it on 2 April 2019 affirming ‘Tony, I would like buy your adamantium for the price stated. Best, Steve.’

Natalia Romanova saw the email and was attracted to the prospect of buying Tony’s adamantium. On 4 April 2019 Natalia sends Tony an email communicating ‘Tony – I would like to by your adamantium for £1000. Regards, Nat.’

Unfortunately, the postal service initially sent Steve’s letter to the wrong address and, in consequence, it did not reach Tony until 26 April 2019. As Tony had not heard from Steve, he thought that he was not interested in the adamantium and sold it to Natalia.
